SuperListings is an AI-powered SaaS platform for Amazon sellers and e-commerce businesses. We provide:

• AI-driven content and listing optimization
• Keyword analysis and research tools
• Listing creation/editing features
• Performance analytics
• Amazon integration for data and automation

Features and availability may vary by plan, subscription, or geography. SuperListings is independent of, and not endorsed by, Amazon.com, Inc. or its affiliates.

We may modify, improve, or discontinue any Service feature at our discretion, in compliance with applicable law and these Terms.

3. Account Registration & Eligibility

The Service is designed for business and professional use, but sole proprietors, freelancers, and individuals are welcome.

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You agree to provide accurate and complete registration information and keep it up to date.
• You are responsible for all activity under your account and for keeping your credentials confidential.
• We may refuse, suspend, or terminate accounts at our discretion, with reasonable notice where required by law.
• You may not open multiple accounts or transfer your account without our written consent.
• You agree to notify us immediately at support@superlisting.io of any unauthorized use of your account.

4. Subscriptions, Billing & Cancellations

Plans & Pricing: Plans, pricing, and features are available in your dashboard and may change; all amounts are in USD unless specified.

Payment Processing: Payments are handled securely through Stripe or our other payment partners.

Taxes: All applicable taxes (GST/HST, QST, state/province/local) will be applied as required by law.

Auto-Renewal: Subscriptions renew automatically unless canceled before the billing period ends. Where required by law, you will be notified before renewal.

Cancellations:

• Cancel via your dashboard or by contacting support.
• Your access remains until the end of the paid period.

Refunds:

• All payments are final and non-refundable, except as required by applicable law.
• If you are a consumer in Quebec or other jurisdictions with mandatory refund rights, you may be eligible for a refund or cancellation as provided by law. Please contact us to exercise your rights.
• Exceptional refunds may be granted at our discretion.
• If you dispute a payment ("chargeback"), we may suspend access pending resolution.

Free Trials: Cancel before trial ends to avoid charges.

5. Acceptable Use

You agree to use the Service lawfully and not to:

• Use bots, scrapers, or unauthorized automation.
• Disrupt, degrade, or harm the Service infrastructure or other users.
• Attempt to access accounts or data not belonging to you.
• Use the Service for illegal or fraudulent activity, including violations of Amazon's rules.
• Copy, reverse engineer, or exploit our code, software, or intellectual property.
• Use stolen or fraudulent payment information.

We may suspend or terminate access for violations, with reasonable notice where required by law.

6. Intellectual Property

All rights to the Service (software, content, brand, code) remain with SuperListings and its licensors.

Your Content: You retain ownership of content you upload or submit. You grant us a worldwide, non-exclusive, royalty-free, revocable license to use, process, and analyze your content solely to operate and improve the Service.

We will not disclose or share your content externally without your consent, except as required for Service operation, legal compliance, or enforcement of these Terms.

7. Privacy

Your privacy matters. Our Privacy Policy explains how we collect, use, and protect your information in accordance with Quebec, Canadian, and US privacy laws.

By using the Service, you consent to our data practices.

If you are located in the European Union, United Kingdom, California, or other jurisdictions with special privacy rights, see our Privacy Policy for additional disclosures.

8. Service Availability, Modifications & Force Majeure

We strive for reliable Service but cannot guarantee uninterrupted access.

We may modify, suspend, or discontinue any part of the Service at any time, and will provide reasonable notice where possible.

We are not liable for Service interruptions due to events outside our control ("force majeure"), including but not limited to natural disasters, strikes, cyberattacks, outages, regulatory action, or third-party failures.

9. Disclaimers

The Service is provided "as-is" and "as-available."

• No guarantee of results, uptime, or performance.
• Your use is at your own risk.
• We do not guarantee compatibility or continued access to Amazon or other third-party platforms.

To the extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes liability where such exclusion is prohibited by law (e.g., for personal injury, gross negligence, or consumer rights).

10. Limitation of Liability

To the fullest extent permitted by law:

SuperListings and its affiliates are not liable for indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, business, or data arising from use or inability to use the Service.

In any case, our total liability for claims will not exceed the amount you paid us in the twelve (12) months before the claim.

Some jurisdictions do not allow certain limitations. In such cases, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless SuperListings, its directors, employees, partners, and affiliates from any claim, loss, or expense (including legal fees) arising from:

• Your violation of these Terms or applicable law;
• Content submitted through your account;
• Your misuse of the Service.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the Province of Quebec and the laws of Canada.

For US users, you also agree to comply with applicable US federal and state laws.

Any disputes shall be brought before the courts in the judicial district of Montreal, Quebec, unless otherwise required by law.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13. Dispute Resolution

If you have a dispute, please contact us first for an amicable resolution.

If unresolved, and where permitted by law, disputes will be resolved exclusively in the courts of Montreal, Quebec.

14. Changes to Terms

We may update these Terms at any time.

Material changes will be notified to you by email or through your dashboard at least 30 days before taking effect.

If you do not agree to the new Terms, you must stop using the Service before the changes take effect. Continued use after changes means you accept the updated Terms.

15. Termination

We may suspend or terminate your account at any time, with reasonable notice where required by law, for violation of these Terms or Service misuse.

Upon termination, your right to access the Service ceases immediately.

Sections regarding intellectual property, limitation of liability, indemnification, and other sections which by nature should survive termination, will survive.

16. Severability

If any provision of these Terms is invalid or unenforceable, the rest will remain in effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, are the entire agreement between you and SuperListings and supersede all prior communications or agreements.
